Elpida Settles Patent Infringement Lawsuit with Infineon

TOKYO, JAPAN, May 20, 2010 – Elpida Memory, Inc., Japan's leading global supplier of Dynamic Random Access Memory (DRAM), today announced that it had reached a settlement with Infineon Technologies in regard to patent infringement lawsuits Elpida filed in early April in U.S. District Court for the Eastern District of Virginia against Infineon and other defendants.

Elpida plans to withdraw its patent lawsuits filed with the Virginia U.S. district court while Infineon and its US subsidiary have agreed to abandon a patent infringement complaint against Elpida and other respondents filed last February with the U.S. International Trade Commission in Washington D.C.

Elpida and Infineon have settled the dispute through a broad patent cross license relating to semiconductor technology. The specific terms and conditions of the license are confidential.

"Both sides are glad to put an end to this dispute," said Yasuo Shirai, CFO and Executive Officer in charge of IP & Legal Department. "At the same time, we have shown that we are committed to protecting our intellectual property rights."
